Eligibility

To be eligible to sell on ContiStyles.com, you must:

• Be legally capable of entering into a binding contract.

• Have a valid business registration and applicable tax identification numbers based on the partnership model you select to sell on ContiStyles.

• Comply with all applicable laws and regulations in the regions where you operate.

Registration and Account

• Registration: You must complete the registration process by providing current, complete, and accurate information as required by us. You must maintain and update this information to keep it current, complete, and accurate.

• Account Security: You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.

Listing Products

• Product Information: You must provide accurate and complete information about each product you list, including but not limited to product name, description, specifications, images, price, and stock availability.

• Compliance: All products must comply with applicable laws and regulations. You are responsible for ensuring that your products do not violate any third party intellectual property rights or other rights.

• Quality Standards: Products must meet our quality standards and be free from defects.

Products Images

• Human Pictures / Models (NOT ALLOWED): This should be looked at with great attention as our market does not support human images for promotion and display by any means for any kind of product. The reason for this condition is to bring about a change in society to abolish body shaming and promote every body type of people.

• Mannequin Usage (ALLOWED): Mannequins are allowed to display the usage of products freely.

Product Safety Directive (GPSD)

The General Product Safety Directive (GPSD) aims at protecting consumers’ health and safety. It is applicable to any product that is placed on the EU market – either by European manufacturers or businesses importing products from outside the EU. The GSPD is also applicable to leather products, including furniture, shoes, and bags.

GPSD requires that importers and manufacturers assess product safety and risks to ensure that the product is not posing risks or threats to consumers. This assessment shall not be limited to adult consumers, but also the usage and behavior of children and infants.

Pricing and Payment

• Pricing: You must set a price for each product, including any applicable taxes. Prices should not exceed the actual selling price and should reflect fair market value.

• Payment Terms: Payments will be processed according to the payment schedule defined in our Vendor Handbook. We will deduct any applicable fees before remitting payments to you.

Shipping and Fulfillment

• Shipping: Depending upon the selected partnership model you are responsible for shipping products to customers in a timely manner. You must use reliable shipping services and provide tracking information.

• Fulfillment Standards: Orders must be fulfilled accurately and shipped promptly. You must adhere to our shipping and fulfilment guidelines as outlined in the Vendor Handbook.

Returns and Refunds

• Return Policy: You must comply with our returns policy, which includes accepting returns within 14 Days of purchase and providing refunds or exchanges as applicable.

• Refund Processing: You must process refunds promptly upon receipt of returned items in accordance with our policy.

Customer Service

• Support: You are responsible for providing customer support for your products. This includes responding to customer inquiries and resolving any issues related to your products.

• Communication: You must maintain professional and courteous communication with customers and our support team.

Intellectual Property

• License: By listing products on ContiStyles.com, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your product listings, trademarks, and other content provided by you for marketing and promotional purposes.

• Ownership: You retain all rights to your intellectual property. This Agreement does not transfer any intellectual property rights to us.

Termination

• By Vendor: You may terminate your account at any time by providing us with written notice.

• By ContiStyles.com: We reserve the right to terminate or suspend your account at our discretion, with or without cause, including for any violation of this Agreement or our policies.

• Effect of Termination: Upon termination, you must cease all use of our platform and any licenses granted to you under this Agreement will immediately terminate.

Limitation of Liability

To the maximum extent permitted by law, ContiStyles.com will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to this Agreement, your use of the platform, or the sale of your products.

Governing Law

This Agreement will be governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles.

Amendments

• Entire Agreement: This Agreement constitutes the entire agreement between you and ContiStyles.com regarding your use of the platform.

• Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

• Waiver: Our failure to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
