Introduction

Welcome to ContiStyles ("we", "us", "our"). These Terms & Conditions ("Terms") govern your use of our website ("Site") and your purchase of products from our Site. By accessing our Site and purchasing our products, you agree to be bound by these Terms.

Eligibility

By using our Site and purchasing products, you represent that you are at least 18 years old or, if under 18, you have the permission and supervision of a parent or legal guardian to use the Site and purchase products.

General

ContiStyles is a marketplace on which other sellers offer their products for sale in their name and on their account or dummy account administrated by ContiStyles admin due to the contractual nature of the contract with brands. The sellers are entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). The products are generally only sold to consumers within the meaning of Section 13 of the German Civil Code (BGB) who are of legal age.

The purchase contract(s) is/are concluded between you and the seller of the items you ordered; the respective seller of an item is displayed at various points in the ordering process, in particular on the item details page, in the shopping cart and before completing the order (“Seller: XY”). The seller of an item is either us or another seller.

Time of Conclusion of Contract

The presentation of goods and services on ContiStyles does not constitute a legally binding offer, but rather general information. By clicking the button "Order now at the stated price" you are making a binding offer to purchase the goods in the shopping cart. Immediately after completing the order process, you will receive an order confirmation by email.

Right of Return:

By using, and ordering on ContiStyles you agree to our Return Policy which you can find in our return policy section on ContiStyles.com too.

If the goods are not complete and in an intact and undamaged condition, compensation for any loss of value can be demanded if the loss of value is due to handling of the goods which was not necessary to check the quality, properties and functioning of the goods.

The voluntary right of return does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The voluntary right of return expires prematurely in the case of contracts for the delivery

• sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery

Furthermore, the right of return does not apply to mixed contracts for the supply of goods and the provision of services with regard to the services included in the mixed contract.

Retention of title:

The goods remain the property of the respective seller until full payment has been made.

Alternative dispute resolution:

The EU Commission offers the possibility of online dispute resolution on an online platform operated by it. This platform can be reached via the external link Online Dispute Resolution | European Commission. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. The same applies to the other sellers.

Contract language/Storage of the order text:

The contract is concluded in English. We do not save the contract text after the contract has been concluded. The details of your order will be made available to you in the order confirmation sent to you by email. The order confirmation also contains these Terms and Conditions.

Account Registration

To purchase products from our Site, you may need to create an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account

Password Security

Users must keep their passwords secret and must not disclose them to third parties. ContiStyles will not disclose the password to third parties either. For security reasons and to prevent misuse of the customer account, a sufficiently secure password should be chosen and the password should be changed at regular intervals. The user is solely responsible for the security of the access data.

By registering and using ContiStyles services, the user agrees to the validity of these terms of use. The ContiStyles customer account opened upon registration can of course be used for orders in ContiStyles shops. You can find more information about your customer account in the "My Account" area.

Product Descriptions and Availability

We strive to provide accurate descriptions and images of our products. However, we do not warrant that the descriptions, images, or other content on our Site are accurate, complete, reliable, current, or error-free. Product availability is subject to change without notice.

Product search

There are a number of suitable products for almost every search query. The products are sorted according to the criterion of attractiveness. ContiStyles proceeds as follows:

• ContiStyles checks whether the individual terms in the search query match the information about a product. This product information includes, for example, the product title or the product description.
• If your search terms match the product information, the product will be selected as part of the search results.
• The better the product information matches the search query, the higher the chance a product has of appearing high in the search results.
• ContiStyles also determines how popular a product is among users. The more often a product has been purchased in the past few weeks, the higher the probability that this product will appear high up in the search results.
• In addition, other attractiveness factors influence the position of a product in the search results. These include, for example, average customer ratings or fast delivery times.

The products displayed can be

• filtered, e.g. by colour, size, price or brand

and/or

• be re-sorted, e.g. by price descending or ascending, ratings

Sponsored products

In addition to these search results, products that are specially marked with the note “sponsored” are also displayed.

Sponsored products are product advertisements that are financed by ContiStyles suppliers and other sellers. ContiStyles ensures that these products match the search query.

Recommendation systems

The user is shown various product recommendations on the ContiStyles website.

If the user consents to cookies, the recommendations are based on the user's surfing behaviour (especially previously viewed products) and purchase history.

Without the user's consent to cookies, the recommendations are based on which products - across all users - have sold the most and are currently trending (i.e. have recently been viewed disproportionately by users)

Pricing and Payment

All prices on our Site are listed in Euros (€) and are subject to change without notice and are also supported by different currencies. The list of currencies is shown in the currency selection dropdown menu. We accept various payment methods, which will be indicated at the time of purchase. You agree to pay all charges incurred by you or any users of your account and credit card or other payment methods at the prices in effect when such charges are incurred.

In order to be able to offer you an attractive range of payment methods on ContiStyles, we cooperate with our third-party payment service provider.

As part of the payment processing by our third-party payments provider, the seller's payment claim against you is assigned to them. As part of your order, you consent to the transfer of your personal data and that of the order to a third-party payments provider for the purposes of identity and credit checks, as well as contract processing.

We reserve the right to only offer you certain payment methods. There is no possibility of a discount.

In individual cases, we reserve the right to only deliver the goods after a deposit has been paid. We will coordinate this with you after we receive your order.

Shipping and Delivery

We ship products to various locations by using their party shipping companies. Shipping fees and delivery times will vary based on the selected shipping method and destination. We will provide estimated delivery times at checkout or later via email but do not guarantee delivery dates. Delays may occur due to unforeseen circumstances.

When ordering items from different sellers, you will generally receive multiple deliveries. The shipping method (parcel or freight forwarding) and the delivery conditions (for freight forwarding) are part of the item information on the item details page. The respective shipping costs for your order are broken down in the shopping cart and in the overview before clicking the "Order now at the stated price" button.

If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the employee of the shipping service provider who delivered the items. Failure to report this will not, however, have any consequences for your legal claims. You are entitled to the statutory warranty rights for defects for all items purchased on ContiStyles.

Returns and Refunds

We accept returns and provide refunds in accordance with our Return Policy, which is available on our Site. To be eligible for a return, items must be unused, in the same condition that you received them, and in the original packaging. Certain items are non-returnable which you can discover in our Return Policy section.

Intellectual Property

All content on our Site, including but not limited to text, graphics, logos, images, and software, is the property of ContiStyles or its content suppliers and is protected by applicable intellectual property laws. You may not use, reproduce, distribute, or create derivative works based on our content without our express written permission.

User Content

You may have the opportunity to post reviews, comments, or other content on our Site ("User Content"). By posting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all rights to the User Content that you post.

Limitation of Liability

To the fullest extent permitted by law, ContiStyles shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Site; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Site; and/or (f) the defamatory, offensive, or illegal conduct of any third party. In no event shall our aggregate liability for all claims relating to the Site exceed the greater of one hundred Euros (€100) or the amount you paid us, if any, in the last twelve months.

Termination of use of ContiStyles services

Users can stop using ContiStyles services at any time without giving reasons. Deletion of profiles at ContiStyles shops and/or services can be requested by the user at any time by contacting customer service or by sending an email to acountdeletion@contistyles.com, provided that there are no reasons to the contrary due to other contractual relationships - e.g. outstanding payment claims. If the customer account at ContiStyles is deleted, profiles at ContiStyles services are blocked and are no longer visible to other users. If the account is deleted, orders are no longer possible without re-registration. After the applicable commercial and tax retention periods have expired, all information is irrevocably deleted. Excluded from deletion are contents that were sent, exported or otherwise transmitted to other social media platforms and/or third parties by ContiStyles or the user and/or other users during the use of ContiStyles services and/or functions, e.g. by using a share function.

To protect the user against unauthorized deletion of his customer account by third parties, ContiStyles may be entitled to verify the user's identity during deletion, e.g. by sending an email in which the user must confirm the final deletion.

ContiStyle's right to terminate the contractual relationship with the user by invoking negative contractual freedom remains unaffected.

Warranty for services

ContiStyles is not liable for any direct, indirect, special losses and/or damages to users arising from the use of ContiStyles services and related to disruptions in communication or power lines, failures in mobile phone operators, the effects of malicious software, unfair actions by third parties aimed at gaining unauthorized access to and/or disabling ContiStyles software and/or hardware, or force majeure. In such cases, ContiStyles is not obliged to reimburse users for any losses.

Liability under the Product Liability Act remains unaffected.

ContiStyles reserves the right to change, add to, delete and/or discontinue parts of the services, the services as a whole and/or individual functionalities and/or the entire offering without separate notice, e.g. to implement a court ruling and/or an authority decision; in the event of changes to the law; to close security gaps or to expand the offering.

Violations of the Terms of Use by the User

In the event of a violation of these Terms of Use, ContiStyles reserves the right to temporarily or permanently block and/or permanently delete the User's customer account - including the respective content.

Indemnification

You agree to indemnify, defend, and hold harmless ContiStyles, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your use of the Site, violation of these Terms, or infringement of any intellectual property or other right of any person or entity.

Governing Law

These Terms and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles.

Changes to Terms

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to our Site or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
